Without a Bill of Rights, America could not have served as the host nation for the Restoration of the gospel, which began just three decades later.
There are other threats that undermine the inspired principles of the United States Constitution. The stature of the Constitution is diminished by efforts to substitute current societal trends as the reason for its founding, instead of liberty and self-government.
The United States Constitution is unique because God revealed that He “established” it “for the rights and protection of all flesh” (D&C 101:77,80). That is why this constitution is of special concern for The Church of Jesus Christ of Latter-day Saints throughout the world. Whether or how its principles should be applied in other nations of the world is for them to decide.
Our belief in divine inspiration gives Latter-day Saints a unique responsibility to uphold and defend the United States Constitution and principles of constitutionalism wherever we live. We should trust in the Lord and be positive about this nation’s future.
The Church of Jesus Christ of Latter-day Saints will, of course, exercise its right to endorse or oppose specific legislative proposals that we believe will impact the free exercise of religion or the essential interests of Church organizations.
We should learn and advocate the inspired principles of the Constitution.
The serious study of the Constitution is a lifelong endeavor. Writing in the Ensign magazine, Elder Dallin H. Oaks repeated what he called his “favorite prescription for patriotism,” which comes from Adlai Stevenson, the former governor of Illinois, who was twice the presidential nominee of the Democratic Party: “Patriotism . . . is not short, frenzied outbursts of emotion, but the tranquil and steady dedication of a lifetime.”
We consider that the men in the Revolution were inspired, by the Almighty, to throw off the shackles of the mother government, with her established religion. For this cause were Adams, Jefferson, Franklin, Washington, and a host of others inspired to deeds of resistance to the acts of the King of Great Britain, who might also have been led to those aggressive acts, for aught we know, to bring to pass the purposes of God, in thus establishing a new government upon a principle of greater freedom, a basis of self-government allowing the free exercise of religious worship. It was the voice of the Lord inspiring all those worthy men who bore influence in those trying times, not only to go forth in battle, but to exercise wisdom in council, fortitude, courage, and endurance in the tented field, as well as subsequently to form and adopt those wise and efficient measures which secured to themselves and succeeding generations, the blessing of a free and independent government. This government, so formed, has been blessed by the Almighty until she spreads her sails in every sea, and her power is felt in every land.
Our belief that the United States Constitution was divinely inspired does not mean that divine revelation dictated every word and phrase...
However, we do not see inspiration in every Supreme Court decision interpreting the Constitution.
We also insist, and we ask our local leaders to insist, that political choices and affiliations not be the subject of teachings or advocacy in any of our Church meetings.

This Constitution is of special importance to our members in the United States, but it is also a common heritage of constitutions around the world.
Mr. President, Senate Joint Resolution 31, concerning which there has been little, if any, public interest or knowledge, constitutes one of the most far-reaching — and I believe mistaken — schemes ever proposed to alter the American constitutional system. No one knows with any certainty what will happen if our electoral system is totally revamped as proposed by Senate Joint Resolution 31 and the various amendments which will be offered to it.
Today, we have a clearly Federal system of electing our President, under which the States act as units. Today, we have the two-party system, under which third parties and splinter parties are effectively discouraged from playing more than a negligible role. Today, we have a system which in all but one instance throughout our history has given us presidents elected by a plurality of the popular vote
And today we have an electoral vote system which gives both large States and small States certain advantages and disadvantages that offset each other.
We see many signs of weakness which we lament, and we would to God that our rulers would be men of righteousness, and that those who aspire to position would be guided by honorable feelings to maintain inviolate the Constitution and operate in the interest, happiness, well-being, and protection of the whole community. But we see signs of weakness and vacillation. We see a policy being introduced to listen to the clamor of mobs and of unprincipled men who know not of what they speak, nor whereof they affirm, and when men begin to tear away with impunity one plank after another from our Constitution by and by we shall find that we are struggling with the wreck and ruin of the system which the forefathers of this nation sought to establish in the interests of humanity. But it is for us still to sustain these glorious principles of liberty bequeathed by the founders of this nation, still to rally round the flag of the Union, still to maintain all correct principles, granting the utmost extent of liberty to all people of all grades and of all nations.

To remain free, we must have a government accountable to us. That is the first precept of constitutionalism. That is what must be restored.

The Constitution’s preamble speaks first of we, the people, and then of their elected representatives. The judiciary is third in line and it is placed apart from the political fray so that its members can judge fairly, impartially, in accordance with the law, and without fear about the animosity of any pressure group. In Alexander Hamilton’s words, “The mission of judges is to secure a steady, upright, and impartial administration of the laws.”
In sum, the Court's conclusion that a constitutionally adequate recount is impractical is a prophecy the Court's own judgment will not allow to be tested. Such an untested prophecy should not decide the Presidency of the United States. I dissent.
Think back to 1787. Who were 'we the people'? … They certainly weren't women … they surely weren't people held in human bondage. The genius of our Constitution is that over now more than 200 sometimes turbulent years that 'we' has expanded and expanded.
When the founders were thinking about and writing the words of the Constitution and protecting certain basic rights in the Constitution, women were not really part of the political process. They didn’t have a right to vote, and there was slavery, and the slaves weren’t part of [the political process either].
The u.s. constitution was and is imperfect. It took a civil war to establish that the principles enumerated in its Bill of Rights extended to all Americans, and the struggle to live up to those principles continues today. But focusing on the Constitution’s flaws can overshadow what it did achieve. Its revolutionary ambition was to forge, out of a diverse population, a new national identity, uniting Americans under a banner of ideas. To a remarkable extent, it succeeded.
The dark underside of that document, of course, was racism. Alone among modern Western democracies, the United States maintained extensive race-based slavery within its borders, and the Constitution protected that institution. Only after the cataclysm of the Civil War was the Constitution amended to establish that America’s national identity was as neutral racially and ethnically as it was religiously.
The United States took another century to begin dismantling the legalized racism that continued unabated after the Civil War. Nonetheless, the core constitutional aspiration—in the 1780s, the 1860s, the 1960s, and the present—has been to create a tribe-transcending national identity.
When we think of tribalism, we tend to focus on the primal pull of race, religion, or ethnicity. But partisan political loyalties can become tribal too. When they do, they can be as destructive as any other allegiance. The Founders understood this. In 1780, John Adams wrote that the “greatest political evil” to be feared under a democratic constitution was the emergence of “two great parties, each arranged under its leader, and concerting measures in opposition to each other.” George Washington, in his farewell address, described the “spirit of party” as democracy’s “worst enemy.” It “agitates the Community with ill-founded jealousies and false alarms, kindles the animosity of one part against another, foments occasionally riot and insurrection.”
The causes of America’s resurgent tribalism are many. They include seismic demographic change, which has led to predictions that whites will lose their majority status within a few decades; declining social mobility and a growing class divide; and media that reward expressions of outrage. All of this has contributed to a climate in which every group in America—minorities and whites; conservatives and liberals; the working class and elites—feels under attack, pitted against the others not just for jobs and spoils, but for the right to define the nation’s identity. In these conditions, democracy devolves into a zero-sum competition, one in which parties succeed by stoking voters’ fears and appealing to their ugliest us-versus-them instincts.
Americans on both the left and the right now view their political opponents not as fellow Americans with differing views, but as enemies to be vanquished. And they have come to view the Constitution not as an aspirational statement of shared principles and a bulwark against tribalism, but as a cudgel with which to attack those enemies.
For some on the left, the document is irredeemably stained by the sins of the Founding Fathers, who preached liberty while holding people in chains.
For all its flaws, the United States is uniquely equipped to unite a diverse and divided society. Alone among the world powers, America has succeeded in forging a strong group-transcending national identity without requiring its citizens to shed or suppress their subgroup identities.
America is not an ethnic nation. Its citizens don’t have to choose between a national identity and multiculturalism. Americans can have both. But the key is constitutional patriotism. We have to remain united by and through the Constitution, regardless of our ideological disagreements.
The right needs to recognize that making good on the Constitution’s promises requires much more than flag-waving. If millions of people believe that, because of their skin color or religion, they are not treated equally, how can they be expected to see the Constitution’s resounding principles as anything but hollow?
For its part, the left needs to rethink its scorched-earth approach to American history and ideals. Exposing injustice, past and present, is important, but there’s a world of difference between saying that America has repeatedly failed to live up to its constitutional principles and saying that those principles are lies or smoke screens for oppression. Washington and Jefferson were slave owners. They were also political visionaries who helped give birth to what would become the most inclusive form of governance in world history.
